Revised guidelines for Registration for Infrastructure Providers – Category I (IP-1)
Following are the guidelines for the registration for Infrastructure Providers – category 1 (IP-1)
- The applicant must not be an individual, but a company that has been incorporated under Companies Act 1956
- Foreign Deposit Investment up to 100%, where the 49% is through the automatic route and beyond it should be certified by the FIPB depends upon the regulations specified in the regulations that have to be adhered to by IP1 License holders in India.
- The Department of Telecommunication will consider both direct and indirect investment of the applicant company.
- In case of foreign deposits, the applicant, the promoter or the investing company, all will adhere to the provisions of FDI policies
- The applicant company shall file the application for IP1 License in the prescribed format
- When it comes to Right of Way, the applicant company has to make its own arrangement
- If the applicant company has to change the name, it can do so under the provisions of the Companies act. It will have to inform the DOT of the same.
- Within 15 days after filing the application, the applicant will either get the license or a rejection letter.
- It’s the duty of the DOT to issue the Ip1 license on non-exclusive basis
- After obtaining the license, the license holder – the applicant – has to provide the resources after signing a mutual agreement.
- The IP1 license holder has to send a copy of that agreement to the Department of Telecommunication
- The IP1 License holder will provide the infrastructure resources in a fair and unbiased manner.

- The applicant company will be issued license which will entail a unique ID and the terms and conditions that validate the possession of that license.
- The IP1 license fee of INR 5000 (non-refundable) will have to be paid to the Department of Telecommunication at the time of issuing the license.
- The application for IP1 is not online. Thus, the applicant has to submit the application form with the rest of the documents to the Section Officer, CS-III, Department of Telecommunications, Room No 713, Sanchar Bhawan, 20, Ashoka Road, New Delhi-110001.
